Terms of sale
Article 1 – Purpose
These General Terms and Conditions of Sale govern all commercial relations between Weird Birdss (hereinafter "the Seller") and any adult natural person (hereinafter "the Customer") making a purchase on the website weirdbirdss.com. Any order placed on the site implies unreserved acceptance of these Terms and Conditions.
Article 2 – Products
The products offered for sale are described and presented with the greatest possible accuracy. Photographs illustrating the products are not contractual and may present slight variations from the actual product (printing, screen colors, material finish).
Article 3 – Prices
Prices are indicated in euros (EUR) for customers residing in the European Union, and may be displayed in US dollars (USD) or other currencies for customers located outside the EU. In accordance with Article 293 B of the French General Tax Code, the Seller benefits from the VAT exemption regime: the prices displayed are therefore net, with no applicable VAT.
Shipping costs are indicated before order validation and are the responsibility of the Customer.
Article 4 – Order
Any order placed on the site constitutes the formation of a contract concluded at a distance. The Customer receives an order confirmation by email. The Seller reserves the right to refuse any order for legitimate reasons (product unavailability, obvious pricing error, previous dispute).
Article 5 – Payment
Payment is due immediately upon order. Accepted payment methods are: credit card (Visa, Mastercard, American Express) via Shopify Payments, and PayPal. Transactions are secure. The Seller does not store any banking data.
Article 6 – Delivery
Products are shipped to the address indicated by the Customer at the time of ordering. Delivery times are indicative and vary depending on destination and product ordered. Products are printed on demand then shipped via our logistics partners: the total time (production + shipping) is generally 7 to 15 business days.
The Seller cannot be held responsible for delays attributable to the carrier or to force majeure events.
Article 7 – Right of withdrawal
In accordance with Articles L221-18 to L221-28 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal, without having to justify a reason or pay any penalty.
To exercise this right, the Customer must notify their decision to withdraw by email to contact@weirdbirdss.com specifying their name, order number, and decision to withdraw.
Return shipping costs are the responsibility of the Customer. The product must be returned in its original condition, unworn, unwashed, undamaged, with its tags. Any product returned incomplete, damaged, worn, or washed will not be refunded.
The refund will be issued within fourteen (14) days of receiving the returned product, using the same payment method as the original order.
Article 8 – Warranties
Products benefit from the legal warranty of conformity (Articles L217-4 and following of the French Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the French Civil Code). In case of printing defect or product not conforming to the order, the Customer can contact contact@weirdbirdss.com within a reasonable time to obtain replacement or refund of the product.
Article 9 – Liability
The Seller cannot be held responsible for non-performance or poor performance of the contract in case of force majeure, disruption or total or partial strike, notably of postal services, natural disaster, or epidemic.
Article 10 – Personal data
Personal data collected as part of orders is processed in accordance with the site's Privacy Policy, accessible from the footer.
Article 11 – Disputes
These Terms and Conditions are subject to French law. In case of dispute, an amicable solution will be sought before any legal action. Failing this, French courts shall have sole jurisdiction.
In accordance with Article L612-1 of the French Consumer Code, the consumer Customer has the option to resort free of charge to a consumer mediator with a view to the amicable resolution of the dispute. European online dispute resolution platform: https://ec.europa.eu/consumers/odr
